This Privacy Policy explains what information we collect when you subscribe to The Business Beneath, why we use it, who processes it on our behalf, and what choices and rights you have.
2. What we collect and why
When you subscribe, we collect your email address and name.
We also keep information needed to administer your subscription and document your consent. This may include the date and time of consent, the version of the consent wording, the signup source, your subscription status, and related technical records.
We use this information to send you The Business Beneath newsletter and occasional emails about related books, tools, events and services.
We also use it to manage your subscription, send and process the double-opt-in confirmation email, honour unsubscribe requests, maintain the security and integrity of the mailing list, and comply with applicable legal obligations.
The legal basis for sending these communications is your consent. You can withdraw that consent at any time by using the unsubscribe link in an email or by contacting us at info@businessbeneath.com.
We do not sell your personal data or use it to build third-party advertising profiles.
3. Email analytics
We measure email opens and link clicks to understand whether the newsletter is being read, which content is useful, and how we can improve future editions.
Our email service provider, Kit, measures opens using a small, unique tracking image contained in an email. When the image is loaded, an open may be recorded. Links in emails may also be tracked when they are clicked.
These measurements are not perfectly reliable. Email providers and security systems may automatically load images or follow links, which can create apparent opens or clicks even when a person did not perform the action themselves.
We use this information only to understand and improve our newsletter, content and delivery. We do not use email engagement data for third-party advertising, cross-site retargeting or advertising profiles.
The signup form tells you before you subscribe that we measure opens and clicks. The legal basis for this newsletter analytics processing is your consent.
4. Kit and other service providers
We use Kit, Inc. as our email and subscriber-management service provider.
Kit processes subscriber information on our behalf in order to maintain the subscriber database, process subscriptions and confirmations, deliver emails, handle unsubscribes and provide email reporting.
We use Amazon Web Services (AWS), including AWS Amplify Hosting, to host and deliver the Business Beneath website. AWS may process technical request and security information necessary to provide and protect the hosting service.
We require service providers handling personal data on our behalf to process it under appropriate contractual and data-protection safeguards.
5. International data transfers
Kit is a United States company, so subscriber information may be processed in the United States or other locations outside the European Economic Area.
Where personal data is transferred outside the EEA, we rely on an applicable lawful transfer mechanism and appropriate safeguards where required, such as an adequacy decision, the EU-U.S. Data Privacy Framework where applicable, or the European Commission’s Standard Contractual Clauses.
The same principle applies where another service provider, including our hosting provider, processes personal data outside the EEA.
6. How long we keep your information
We keep your subscriber information while you remain subscribed and for as long as it is reasonably necessary to operate the newsletter and manage the relationship with you.
If you unsubscribe or withdraw your consent, we will stop sending you the marketing communications covered by that consent and remove you from active marketing use without undue delay.
We may retain limited information where genuinely necessary for a separate legal purpose, such as demonstrating compliance with an unsubscribe or consent withdrawal, defending a legal claim, or preventing communications from being sent contrary to your request. We will not continue using such retained information for marketing.
We do not retain personal data simply because it may be useful someday. When information is no longer necessary for the purpose for which it is held, it should be deleted or anonymised.
7. Website tracking
The Business Beneath newsletter signup page is designed to minimise visitor tracking.
We do not use Kit’s hosted-page visitor tracking on the external signup page, and the signup form is designed not to contact Kit until you actually submit your subscription.
We currently do not use optional third-party advertising or visitor-analytics technologies such as Google Analytics, Meta Pixel, Kit Insights, Hotjar, Microsoft Clarity or comparable cross-site tracking on the signup page.
The website is hosted through AWS Amplify. Its hosting infrastructure may process and retain technical access and security information associated with web requests, such as an IP address, request time, browser information, requested resource and security-related log data. We use the hosting service for delivery, reliability and security, not to create advertising profiles or track your activity across unrelated websites.
If we later introduce optional website analytics, advertising technologies or other non-essential tracking, we will update this Privacy Policy and obtain consent where required before enabling that tracking for visitors who require such consent.
8. Your choices and rights
You can unsubscribe from The Business Beneath at any time using the unsubscribe link included in our emails. You may also withdraw your consent by contacting info@businessbeneath.com.
Depending on the circumstances and applicable law, you may have the right to request access to your personal data, correct inaccurate information, request deletion, restrict certain processing, receive certain data in a portable format, or object to processing based on legitimate interests.
Where processing is based on consent, you can withdraw your consent at any time. Withdrawal does not affect the lawfulness of processing that took place before consent was withdrawn.
To exercise your rights, contact us at info@businessbeneath.com. We may need to verify your identity before acting on a request.
9. Complaints
If you have a concern about how we handle your personal data, we would appreciate the opportunity to address it first. You can contact us at info@businessbeneath.com.
You also have the right to lodge a complaint with the competent data-protection supervisory authority.
